eBay scam, advice needed !

In case you remember, 2 weeks ago I put out a post discussing my "won" 2012 Allen & Ginter Silk CC Sabathia (#/10). After I won the auction for a very good price the seller send me a message (not through eBay, clue #1) that the card was returned to him by the US postal service and that it was part of an accident which also destroyed the envelop as well as the card (remarkable story, hint #2?) !! For more details do check out my previous post on the matter. At the time I was a bit suspicious but I usually believe in the goodness of mankind (and the seller had 100% feedback) hence decided to believe it and accept the refund (what else could I do). Of course I rather would have received this card at the price I won it at but not much I could do about it.

As I am chasing these Silk A&G cards of my favourite players I kept checking eBay of course as there should still be 9 other version of the same kind somewhere on the globe. I think you know where I am going with this.....yes, the next one that popped-up was the same card, also numbered 8/10. Also the photo of the card was different hence this person (also with 100% feedback) did not simply copy the picture and set-up a scam auction. As I really wanted this card I decided to bid and won the auction. However, I now paid $20 more compared to the first auction.....

My thinking was, let's e-mail the first guy and ask him for a $20 paypal gift as he obviously sold the card to someone else for more, compared to what I won it for, in the mean time (and lied to me about it being destroyed). In return I can give him positive feedback on his auction. and move on. Hopefully I have the card in hand by the end of the week so I don't run any risk of the second guy holding on to the card and also refunding me the money (in case seller #1 and #2 have some sort of relationship).

The time for starting a dispute regarding auction 1 ends on the 14th so I need to decide fairly soon what to do. What do you guys think I should do in this case ? Although seller #1 refunded me the money, he did lie to me and in the end I am paying $20 more for the same card so I do feel this is not right....

Thanks !!

Ah, and here it is again...photo from seller 1

Here's the photo from seller 2...(photoshoped from seller 1's photo seems verty unlikely to me so I guess seller 2 has/had it in hand).

  1. I'd leave him negative feedback and explain why.

  2. I agree with FISHLEGBOOTS. There are a lot more people doing scams like this.

  3. I think that's a pretty good idea, about the trying to get a gift card from the guy. If he refuses, then I'd give him negative feedback and alert ebay. Save the pictures and them email too.

  4. I have to think ebay can see if it is the same address or town this person is in when they check his sign up profile.. I HATE dishonesty more so when its something like this senerio. I had an issue where I received the wrong cards , the seller refunded me that day but the other buyer was holding my cards hostage even though the seller refunded his buy.. I hope you get some sort of satisfaction in this.

  5. Looks to me like someone didn't want to do international shipping and found a way to lie their way out of it, sell the card off or give the card to someone with an eBay account to re-sell it. You should fight it for sure.

  7. I go farther and report the sale to eBay. I had a sale that no matter how often I emailed the seller, never recvd the product. Opened a ticket and in a week I got my money back. Granted, you got a refund, but if eBay can find enough due cause in these two sales, especially since they can track if the card was sold to you, then sold to someone else, you may get that extra $20 back. It's free to file, so you have nothing to lose.

  8. Oooh, can't wait to see if you wrote about what you did. That makes me mad! How stupid to try to sell a card that limited and hope to get away with it.
